
Texas HB 3749 – Jenifer’s Law: What It Means for LVNs and IV Therapy Practice
Effective September 1, 2025, Jenifer’s Law (House Bill 3749) creates new rules for who can perform elective IV therapy in Texas. This legislation was passed after the tragic death of Jenifer Cleveland, who received an IV infusion at a wellness spa that lacked proper medical oversight.
What the Law Does
Under HB 3749, “elective IV therapy” refers to IV infusions provided for hydration, vitamins, or general wellness—not medically necessary treatments performed in hospitals, clinics, or physician offices.
The law now requires that all elective IV therapy performed outside those traditional medical settings must be:
- Ordered or prescribed by a physician, APRN, or PA, and
- Administered only by a physician, APRN, PA, or RN under physician supervision.
What This Means for LVNs
This change directly affects LVNs who currently work in IV hydration lounges, spas, and mobile wellness services.
- LVNs will no longer be allowed to start or administer elective IVs in these settings.
- Only RNs and above may legally perform the IV insertion and infusion once the law takes effect.
- LVNs may still assist with vital signs, intake, documentation, and patient monitoring, but cannot administer the IV itself.
- The restriction applies only to elective IV therapy—LVNs working in hospitals, clinics, or physician offices under standard delegation rules are not affected.
